Kdence — Terms of Service

1. Agreement between you and us

These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and George Zoiade ("we", "us", "our"), the developer of the Kdence mobile app ("Kdence", "the app", "the service").

By downloading, installing, or using Kdence, you agree to these Terms. If you don't agree, don't use the app.

2. Who can use Kdence

You must be at least 16 years old to use Kdence. This age minimum aligns with Romanian Law 190/2018 Art. 8, which sets the digital-consent age at 16 for the processing of personal data.

If you're between 16 and 18, you can use the app but any contractual capacity questions are governed by your local law.

If you're using Kdence on behalf of a business or organization, you personally represent that you have the authority to bind that organization to these Terms.

3. What Kdence is (and isn't)

Kdence is a personal productivity app for planning tasks, tracking goals, running focus sessions, and reflecting on your week. It is:

• A personal-use tool. For your own scheduling, habit-building, and reflection.
• Provided as-is. We do our best to keep it working, but see Section 9 — we can't guarantee it's bug-free or that any particular feature will improve your productivity.

Kdence is not:

• Medical, psychological, legal, or financial advice. If Kdence suggests you're skipping tasks in a particular category or that your focus sessions are shortening, that's a pattern in your own data — not a diagnosis. Consult a qualified professional for anything that affects your health or well-being.
• A replacement for medication, therapy, or professional coaching.
• A service for the safety-critical management of anything (medication schedules, emergency response, etc.). Don't rely on Kdence for reminders where a missed reminder could cause harm.

4. Your account

Kdence works anonymously from first launch — no account required to use most features locally. You can optionally sign in with an email address or Google account to:

• Back up your data to the cloud so it survives reinstalls and device changes.
• Sync your data across multiple devices.
• Access any paid features, if we ever introduce them — see Section 7.

When you sign up, you agree to:

• Provide accurate information. Don't sign up under a false identity.
• Keep your credentials secure. Don't share your password. If you suspect someone else has access to your account, contact us at support@k-dence.app immediately.
• Be responsible for your account. Anything done via your account is treated as your action.

5. Acceptable use

You agree not to use Kdence to:

• Break any law that applies to you.
• Harass, threaten, or harm any person (including yourself — please seek help if you need it; we don't replace it).
• Reverse-engineer, decompile, or otherwise attempt to extract our source code, except to the extent permitted by mandatory local law.
• Circumvent our security controls, rate limits, or any feature gates we may put in place.
• Use the app to store or transmit malware, phishing content, or unlawful content.
• Send automated queries or attempt to scrape our backend.
• Impersonate anyone or misrepresent your affiliation with anyone.

Since Kdence is personal-use only right now (no sharing, no social features), the acceptable-use list is short. It would grow if we ever added social features — another thing we may or may not do.

6. Your content

Anything you enter into Kdence — task titles, goal descriptions, reflection notes, category names — is your content. We claim no ownership of it. You give us a limited, non-exclusive, worldwide license to store, process, and display it back to you for the sole purpose of operating the app on your behalf. That's it.

You are responsible for the content you enter. Don't enter anything you don't have the right to store, and don't enter anything you'd be embarrassed to see if the servers were breached (see Section 9 on liability).

7. Price

Kdence is free. Every feature in the app today is available at no charge, and we are not accepting payments.

We might introduce paid features one day. We might not. We haven't decided. Whether Kdence ever has a subscription, a one-off purchase, or any paid tier at all depends on how the product actually develops over the coming months — and nothing in these Terms is a promise that it will. Staying free indefinitely is a perfectly possible outcome.

We're saying this out loud rather than staying quiet about it, because we'd rather reserve the option honestly than surprise you later. So — if we ever do introduce paid features, all of the following apply:

• We will tell you in-app before any feature you already use moves behind a payment.
• Anything you had access to for free stays available to you at no charge for a reasonable transition period, and we will tell you how long that period is when we notify you.
• Separate terms covering pricing, billing, refunds, auto-renewal and VAT will be added to this document and communicated to you before they take effect. You won't be charged for anything without agreeing to those terms first.
• You will never be charged silently, and we will never turn an existing free account into a paying one without an explicit action from you.

Until and unless that happens, Kdence is free, and these Terms describe a free service.

8. Third-party services

Kdence uses services provided by third parties. Your use of Kdence is also subject to those third parties' terms:

• Google Firebase (Firebase Analytics, Crashlytics, Firebase Authentication for Google Sign-In) — firebase.google.com/terms
• Supabase (cloud database, authentication) — supabase.com/terms
• Apple App Store (if you downloaded via iOS) or Google Play Store (if via Android) — their respective terms

We are not responsible for the actions or omissions of these third parties. If Supabase goes down, Firebase changes its pricing model, or Apple removes the app from the store, the app may become partially or fully unavailable through no fault of ours.

9. Disclaimers

Kdence is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the app will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• Warranties about the accuracy, reliability, or completeness of any content, suggestion, or insight the app provides.

If we ever ship the "intelligent suggestions" feature we've considered, it would compute patterns from your own data and surface them to you. These are patterns, not advice. An insight saying "you skip evening tasks 60% of the time" is a statistical observation about your past behavior. It is not a recommendation to change your schedule, and following it is at your own discretion.

You use Kdence at your own risk.

10. Limitation of liability

To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or relating to Kdence is limited to:

• The greater of €50 or the amount you have actually paid us in the 12 months before the claim arose. While Kdence is free, that means €50.

We are not liable for:

• Indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or loss of goodwill).
• Damages arising from your reliance on any insight, suggestion, or reminder generated by the app.
• Damages arising from your failure to back up your own data (though we do maintain cloud backups for signed-in users, we don't guarantee they'll be recoverable in every failure mode).
• Damages arising from third-party service outages (Supabase, Firebase, App Store, etc.).

Mandatory consumer protections: Nothing in these Terms limits or excludes your rights that cannot be limited or excluded under Romanian consumer-protection law (OG 21/1992 and related) or under mandatory EU consumer-protection law (Directive 2011/83/EU on consumer rights, as implemented in Romania). If any part of this section conflicts with those, the mandatory protections prevail.

11. Termination

By you: you can stop using Kdence any time. Uninstall the app; delete your account from Settings → Danger Zone → Delete Account. Deletion is permanent.

By us: we can suspend or terminate your account if you:

• Materially breach these Terms (especially the acceptable-use rules in Section 5).
• Attempt to attack the service or its users.
• Fail to pay for a paid feature, if we ever introduce one and you have signed up for it.

We will give you reasonable notice of a termination unless the breach is severe (e.g. you're attacking the service). On termination, your right to use the app ends immediately, but sections that by their nature should survive (disclaimers, limitation of liability, governing law) do survive.

12. Changes to these Terms

We may update these Terms occasionally — for example, when we add new features or change service providers. When we make material changes (things that meaningfully affect your rights or obligations), we will notify you in-app before the changes take effect. Non-material changes (typos, clarifications) will be published to this page with an updated "Effective date" at the top.

If you don't agree with a material change, you can delete your account before it takes effect. Continuing to use the app after a material change indicates your acceptance of the new Terms.

13. Governing law and disputes

These Terms are governed by the laws of Romania, without regard to conflict-of-laws principles.

For any dispute arising out of or relating to these Terms:

• Consumer users (i.e. individuals using Kdence for personal purposes, which is the current default): you retain all mandatory consumer-protection rights under Romanian and EU law, including the right to bring proceedings in your country of residence.
• Business users: disputes are subject to the exclusive jurisdiction of the courts of Bucharest, Romania.
• Both: we encourage informal resolution first. Please contact us at support@k-dence.app before filing anything — most misunderstandings are resolved in a single email.

If you are an EU consumer, you also have the right to use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

14. Miscellaneous

• Entire agreement: these Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Kdence.
• Severability: if any part of these Terms is found unenforceable, the rest continues to apply.
• No waiver: our failure to enforce any part of these Terms doesn't mean we've given up the right to enforce it later.
• Assignment: you can't transfer these Terms to someone else without our written consent. We can transfer them to a successor entity (e.g. if Kdence becomes a company).
• Language: these Terms are drafted in English. If we publish a Romanian translation, the English version prevails in case of conflict — except where mandatory Romanian consumer-protection law requires the Romanian version to prevail.
